Membership Release

THE RUNREC MEMBERSHIP APPLICATION & AGREEMENT

This Membership Agreement (“Agreement”) is entered into between RunRec Inc. ("RunRec") and the undersigned applicant ("Member").

By signing this Agreement, Member acknowledges and accepts all RunRec Membership Policies, Facility Rules, Booking Rules, and Conduct Standards described herein.

RunRec is a 24/7 automated sports facility, operating with minimal staff on-site. Members must understand that they are responsible for their own safety, behaviour, and compliance at all times.

For clarity in this Agreement:

  • “Member” refers to the individual signing this document.
  • “Booking” refers to any court reservation made through the RunRec online system.
  • “Included Hours” refers to the allocated annual court hours provided as part of the Membership.

MEMBERSHIP TERM & BILLING

12-Month Membership Term

  • Memberships run for 12 months from the activation date.
  • Memberships auto-renew into a new 12-month term unless cancelled according to RunRec’s cancellation policy.

Included Hours

  • Members receive all included court hours upfront for the full year.
  • Hours may be used at any time during the 12-month term.
  • Unused hours expire at the end of the term and do not roll over.

Membership Renewals

  • If not cancelled, the membership automatically renews for another 12-month term.
  • All standard policies, rules, and obligations apply to renewed terms.

Communication Requirement

Members agree to maintain accurate contact information and to review all communication sent by RunRec, including booking confirmations, policy updates, and schedule-related notices.

BOOKING RULES & FACILITY USE

Booking Platform

All bookings must be made through RunRec’s online booking system.

Advance Booking Window

  • Common User: 6 weeks
  • Frequent User: 8 weeks
  • Super User: 12 weeks

Rescheduling

  • Members may reschedule once every 30 days.
  • Minimum 7 days’ notice required.

Additional Hours

  • Additional hours may be purchased at:
    • 5% off for Common Users
    • 10% off for Frequent & Super Users
  • Additional hours must be prepaid.

Usage

  • Members may book courts for themselves and their group.
  • The Member must be present for all bookings made under their membership.
  • Members are fully responsible for the behaviour, damages, and rule compliance of all participants in their booking.

Late Arrival & No-Show

  • Booking time begins at the scheduled start time.
  • Unused time is forfeited and cannot be refunded, credited, or rescheduled.

24/7 Automated Access

  • Doors unlock and lights turn on 5 minutes before the scheduled start time.
  • If a Member arrives outside their booking window, doors will remain locked.

Facility Readiness Disclaimer (INSERTED)

Members acknowledge that minor variations in equipment setup may occur and agree to use equipment responsibly or adjust it safely within posted guidelines.

CONDUCT, BEHAVIOUR & FACILITY RULES

Members agree to abide by all RunRec facility rules, including:

Footwear & Equipment

  • Indoor, clean, non-marking athletic shoes only.
  • No outdoor or wet shoes on the court.
  • No food or drinks on the courts (water OK on sidelines).
  • Use equipment responsibly; report any issues immediately.

Behaviour Expectations

  • Members and all participants must behave respectfully at all times.
  • No abusive language, harassment, disruptive conduct, or unsafe activity.
  • No alcohol, smoking, vaping, or illegal substances.
  • No subletting, sharing, or reselling membership hours.

Respect for Facility & Artwork

  • Members must respect all murals, artwork, branding elements, and facility property.
  • Damage caused by the Member or their group will be billed directly to the Member.

Music & Noise

  • Music must be family-friendly and played at reasonable volume via the Bluetooth speakers.

Cleanliness

  • Members must leave the court area clean after use.
  • All belongings must be removed at the end of the session.

Security & Monitoring

  • The facility is under 24/7 video surveillance for safety and security.
  • Misuse of access, including letting others enter without a booking, will result in membership suspension or termination.

PAYMENT STATUS & ACCOUNT STANDING

Good Standing Requirements

  • All membership payments must remain up to date.
  • Missed payments may result in:
    • Suspension of 24/7 access
    • Loss of booking privileges
    • Possible termination if not resolved

RunRec reserves the right to pause access for any account in arrears.

CANCELLATION & REFUND POLICY

Cooling-Off Period

  • Members may cancel within 30 days of joining.

After 30 Days

  • Membership becomes a full 12-month commitment.
  • Early cancellations are not permitted.
  • Membership fees already paid are non-refundable.

Mid-Month Cancellation

  • If cancelling at the end of the 12-month term, access continues until that month’s billing cycle ends.

Unused Hours

  • Do not roll over into future terms.
  • Are non-refundable.

Early Cancellation Consequences

If a Member cancels early in violation of the contract terms, RunRec may:

  • Revoke all perks or discounts used
  • Require repayment of discounted hours
  • Suspend access until obligations are met

MEMBER RESPONSIBILITY FOR DAMAGES

Members are financially responsible for:

  • Any damage to facility property
  • Any equipment damaged by themselves or their group
  • Any violation of RunRec rules that causes financial loss

Invoices for damages are due immediately upon receipt.

ASSUMPTION OF RISK & LIABILITY WAIVER

RunRec is an unsupervised, automated gym facility.

By signing this Agreement, Member understands and agrees:

  • Participation in sports activities carries inherent risk, including injury.
  • Member voluntarily assumes all risks associated with using the facility.
  • Member releases RunRec, its owners, employees, contractors, and affiliates from any liability related to injury, loss, or damage occurring during use of the facility.
  • This release applies to the Member and all participants attending under the Member’s booking.

Governing Law & Severability

This Agreement is governed by the laws of Ontario. If any provision is found unenforceable, the remaining sections will remain in full effect.

AGREEMENT & SIGNATURE

By signing below, the Member confirms:

  • They have read and understood this Membership Agreement.
  • All information provided is accurate.
  • They understand all membership terms, booking rules, and facility expectations.
  • They voluntarily agree to abide by all RunRec policies.
  • They acknowledge full responsibility for themselves and any participants in their bookings.

This Agreement applies solely to the Member and does not grant rights or protections to any third party.

Release of Injury Liability

  1. The Organization desires protection against any personal liability, claim, suit, action, loss, or damage that may result from the Participant participation in the Activities.
  2. The Participant wishes to minimize any hardship the Organization might suffer as the result of any personal liability, claim, suit, action, loss, or damage that may result from the Participant’s participation in the Activities.

In consideration and as a condition of the Participant and the Organization entering into this Agreement and other valuable consideration, the receipt and sufficiency of which consideration is acknowledged, the Participant and the Organization agree as follows:

Definitions:

  1. “Organization” means the following: The corporation 13111946 Canada Inc., operated as The Run Rec, their respective directors, officers, committee members, members, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facility, and representatives.
  2. “Participant” means the following: The legal guardian of the individual(s) who sign this document for their child to participate during the reservation for a time slot at The Run Rec, fully representing (in any capacity as spectators, players, etc.) any and all individual(s) who they signed on behalf of that attend the facility during the time that has been reserved, during the “Activities”.
  3. “Activities” means the following: Reserving and/or spectating during and/or attending and/or playing during the time slot reserved at The Run rec, located at 283 Northfield Road Waterloo Unit 13, Ontario, N2J 4G8, for sports and recreational purposes only.

The Organization is not responsible for any injury, property damage, expense, loss of income, damage or loss of any kind suffered by the Participant during, or as a result of, the Activities, caused in any manner whatsoever including, but not limited to, the negligence of the Organization.

The Participant understands and acknowledges that the Activities have foreseeable and unforeseeable inherent risks, hazards, and dangers that no amount of care, caution, or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis and loss of life. The Participant understands and acknowledges that a pertinent risk to participating in the Activities is the risk of suffering serious head injury should the Participant, fall, trip, or stumble on the playing surface, or within or around the premises. The Participant agrees to be participating voluntarily in the Activities. The Participant acknowledges to be aware of the risks, dangers, and hazards associated with or related to the Activities.

In consideration of the Organization allowing me to participate in the Activities, the Participant agrees:

  1. That their physical condition is appropriate to participate in the Activities
  2. To comply with the rules and regulations for participation in the Activities
  3. That if they observe an unusual significant hazard or risk, they will remove themselves from participation and bring such to the attention of the Organization immediately
  4. That the Organization does not undertake to provide health, accident, disability, hospitalization, personal property or other insurance for the Participant in the Activities

In consideration of the Organization allowing me to participate in the Activities, the Participant agrees:

  1. The sole responsibility for their safety remains with themselves
  2. To assume all risks arising out of, associated with, or related to their participation
  3. To waive any and all claims that they may have now or in the future against the Organization
  4. To freely accept and fully assume all such risks and possibility or personal injury, death, property damage, expense and related loss, including loss of income, resulting from their participation in the Activities, events, and programs of the Organization.
  5. To forever release the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which they may have or may in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organizations.

When reserving a time to utilize the premises owned and operated by The corporation 13111946 Canada Inc., the Participant hereby understands that they are attending and using the facility at their own risk. The Organization shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by the Participant in or about the premises. The Participant hereby fully and forever releases and holds harmless the Organization from any and all claims, demands, damages, or right of action, present or future resulting from the Participant’s use of the facility. In addition, the Participant agrees that they will follow the rules and conduct set by the Organization. Failure to do so may result in suspension from participation. The Participant, the undersigned, does hereby authorize the Organization to utilize any and all photographs, pictures, videos, or other likeness of them as deemed appropriate in its promotional materials.

The Participant certifies that they are 18 years of age or older.

The Participant hereby certifies that they fully represent the minor(s) they brought to attend the facility during the time that has been reserved, for the duration of the “Activities”.

The Participant hereby certifies that they will vacate the premises in a prompt manner following the conclusion of the “Activities”. Failure to do so may result in additional fees responsible by the Participant.

The Participant agrees that they are fully liable for any damage caused to, within, and around the premises, including but not limited to fixtures and equipment during the course of the “Activities”, or during the period of entry and exit from the facility before and/or after the conclusion of the “Activities”.

The Participant certifies that they are responsible for the supervision of the individual(s) under the age of 18 who they brought to attend the facility during the reserved time slot, whether as a spectator, a player, or for any other purpose.

The Participant acknowledges that the Organization is not responsible for any lost or stolen items.

What are your operating hours?

The RunRec is open 24/7. You can book a court any day and any time.

What is your refund policy?

There are no refunds, no re-bookings, and no cancellation for any bookings that are purchased. If you have additional questions about booking a slot feel free to contact us here.

Can I host my league at The RunRec?

Absolutely! - We welcome all custom leagues to be housed within our facility. Please fill out this form and we will get you setup as soon as possible.

Can I bring weighted equipment to the gym?

Any free-weights, included weighted equipment &/or basketballs are not permitted on the court

What kind of footwear do we need within the facility?

Indoor shoes are only permitted on the court during play. When you enter into the facility make sure to change into the appropriate footwear before stepping on the court.

Are we allowed to eat or drink inside the facility?

Yes - All food & drinks is permitted on the bleacher area (off the hardwood court).

Can I host my training sessions at The RunRec?

Absolutely! - Please fill out this form with all your needs and we will respond to you as soon as possible.

Photography Permits

We believe photography is a great way to capture memories and special moments. However, it’s important to be respectful of other people when taking pictures.

If you’re going to be taking pictures of people, make sure to get their permission first. Nobody wants to have their picture taken without their consent.

That being said, feel free to take pictures inside the facility. Just be sure to respect other people’s privacy and space.

Inappropriate Behaviour

We reserve the right to remove any guests who behave inappropriately from the premises. This includes but is not limited to: trespassing, vandalism, theft, and harassment.

We want everyone to feel welcome and comfortable on our property, and we will not tolerate anything less. Thank you for your understanding and cooperation.

How can I book multiple sessions at one time?

Contact us here so we better understand which days in advance you want booked off and get you setup.

Can I Use the Facility to Teach Yoga?

Yes you can absolutely use our facility to teach other activities! We have a full court as well as two training courts that are multi-purpose and have the space you need to accommodate your class.

So whether you are an experienced instructor or are just considering teaching classes for the first time, we welcome you to use our facility to help your students reach their full potential.

Do I Need to Have Insurance?

We believe your safety is always our top priority. However, we are not responsible for any injuries that may occur while playing in our facility.

We recommend that all participants rely on their own insurance coverage to protect themselves in case of an accident. While our courts are well-maintained and our staff is highly trained, accidents can still happen.

With insurance, you can rest assured knowing you will be covered in an emergency. We appreciate your understanding.
